SEC Charges Ripple and Two Executives with Conducting $1.3 Billion Unregistered Securities Offering
The US Securities and Exchange Commission (SEC) filed a $1.3 billion lawsuit against two of Ripple’s key executives on December 22, violating the Securities Business Act.
The status of Ripple coin (XRP) has been hotly debated over the past few years, but the SEC concluded that XRP’s status as a security, and Ripple sold XRP to individual investors for the past 7 years without registering it as a security. 그러나 알고리즘으로 리스크를 분산시키는 다른 암호화폐와 달리 중앙집중화된 발행, 유통구조를 가지고 있고 채굴방식이 아닌 프로토콜 합의알고리즘으로 선택된 노드만 합의에 참여할 수 있는 구조인 점 등이 SEC로 부터 증권으로 인식된 것 같습니다. 참고로 SEC에서는 비트코인과 이더리움 정도만 상품으로 인정하고 있으며, 나머지는 증권으로 보고 있습니다. 이더리움도 POW에서 POS로 바뀌는 과정이라 나중에 리플과 같은 처지에 놓일 가능성도 있습니다.
